Terms of service

Last updated:

These terms apply between Anno One Corporation Ltd (HE442910), Cyprus (“we”), and the business or organisation using InfraHarbour (“the customer”). By creating an account or using the service, the customer accepts these terms.

1. For businesses only

The service is for businesses and organisations in the course of their trade, not for consumers. Whoever accepts these terms confirms that they are authorised to bind the customer.

2. The service

InfraHarbour reads from the customer’s providers of domains, DNS, sites, servers and SEO and brings it into one place. Changes to DNS are only made as proposals that someone authorised on the customer’s side approves.

What is included, the price and any service level follow from a separate agreement or from what the customer has chosen. In case of conflict, the following apply in this order: a separate written agreement, the data processing agreement in matters of personal data, and last these terms.

3. The service as is

The service is provided as is and as available. Unless expressly agreed otherwise in writing, we give no warranties, express or implied, that the service is free of errors, uninterrupted, secure against every attack or fit for a particular purpose.

4. The customer’s responsibility for decisions

Every change approved in the panel is the customer’s decision and the customer’s responsibility — whether the proposal comes from a user, from the panel itself or from an AI agent or script the customer has given a key. The panel’s checks, previews, backups and warnings are aids and no guarantee that a change is correct or harmless.

The customer is responsible for whom it invites, which roles and keys they get, and for keeping sign-ins secure. If the customer discovers unauthorised access it must tell us at once at contact@infraharbour.com.

5. The customer’s keys and providers

The customer chooses which keys it gives the panel and what access they have, and is responsible for having the right to use them. Loopia, Cloudflare, GoDaddy and the other providers are the customer’s own providers. We are not liable for their services, APIs, outages, changes, prices or terms, or for the consequences of them.

6. The customer’s content and backups

The customer is responsible for what it puts into or fetches into the panel, and for having the right to do so. The panel’s backups and exports are an extra aid and do not replace the customer’s own backups.

7. What the customer may not do

  • Use the service for domains or systems the customer has no right to control.
  • Try to reach other customers’ data, get around permissions or probe the security of the service without our written consent.
  • Load the service or the providers’ APIs in a way that disturbs others.
  • Copy, resell or build a competing service on InfraHarbour.
  • Use the service against the law.

8. Suspension

We may suspend an account or a key in whole or in part, without prior notice, where needed to protect the service, other customers or third parties, on suspected misuse or breach of these terms, or if payment is not made. We tell the customer as soon as possible.

9. Changes to the service and prices

We develop the service continuously and may change, add and remove features. Significant reductions and price changes are announced at least 30 days in advance; the customer may then terminate the agreement with effect from the day the change applies.

10. Limitation of liability

We are never liable for indirect or consequential loss, such as lost profit, lost revenue, lost or corrupted data, lost goodwill, business interruption, expired domains, undelivered email or sites that did not answer.

Our total liability under the agreement, on any ground, is limited to what the customer has paid for the service in the 12 months immediately before the event that gave rise to the claim. For accounts that do not pay, liability is limited to 100 euros.

These limits do not apply to the extent liability cannot be limited under mandatory law, such as for intent or gross negligence.

11. The customer’s liability to us

The customer shall indemnify us against third-party claims, and related costs, arising from the customer’s content, the customer’s keys and approvals, the acts of the customer’s users or agents, or the customer’s breach of these terms.

12. Time limit for claims

Claims against us must be made in writing within six months of the customer noticing, or when it should have noticed, the fault. Otherwise the right to claim is lost.

13. Force majeure

We are not liable for delay or failure caused by circumstances beyond our reasonable control, such as outages or changes at sub-processors or the customer’s providers, failures of the internet or power grid, attacks, decisions of authorities, war or natural events.

14. Intellectual property

The service, the software and all content we provide belong to us or our licensors. The customer receives a non-exclusive right to use the service for the term of the agreement. We may freely use suggestions and feedback the customer gives about the service.

15. Confidentiality

Each party keeps the other party’s confidential information secret, as long as it is not publicly known or must be disclosed by law.

16. Termination and the customer’s data

The agreement runs until further notice unless otherwise agreed, and can be terminated as agreed. After termination the account’s data is deleted within 30 days; until then the customer can export its zones. After that, the data cannot be restored.

17. Changes to the terms

We may change these terms. Changes to the customer’s disadvantage are announced at least 30 days in advance. If the customer keeps using the service after that, the new terms apply.

18. Miscellaneous

The customer may not assign the agreement without our written consent. We may assign it to a company in the same group or to whoever takes over the business. These terms, the data processing agreement and any separate agreement form the entire agreement. If a provision is invalid, the rest still applies.

19. Governing law and disputes

These terms are governed by the law of Cyprus. Disputes shall be settled exclusively by the courts of Larnaca, Cyprus. This agreement is written in English. Translations are for convenience only, and if they differ the English text prevails.
